image.canon Terms of Use
1. About image.canon
image.canon is an image storage service (the “Service”) provided by Canon (as defined in Section 23 below) that allows users, among other things, to (i) store images, (ii)sort images, (iii) share images with third parties, (iv) connect to Linked Services (defined below) to share images and (v) connect to the paid services offered on image.canon platform. Those who have a Canon ID account and agree to these Terms of Use (the "Terms") may use the Service (the “Member”, collectively the “Members”). These Terms apply to use of the Service by each Member.
Each paid service is subject to its own terms of use. If a Member chooses to purchase a paid service, the Member understands and agrees that the Member will be subject to the terms of use for the paid service, as well as any terms and conditions of any third-party website(s) used to facilitate purchase of the paid service or associated with the paid service.
The Service enables each Member to (i) upload or download digital images (including annotation data (i.e., information embedded in such digital images (please see Section 10 for full details)) of (a) still images with or without audio; and (b) motion images with or without audio (collectively, the “Image”);, to and from Members’ designated storage associated with the Service, and (ii) send a link to the Image selected by the Member to any third party who the Member selects which allows such third party to download the Image from such link. When a Member uploads an Image to the Service, a thumbnail (which is a JPEG image) of the Member’s Image is automatically created from the original Image (the thumbnail, collectively with the Image, the “Content”), for ease of viewing. Thumbnails of still images will not contain audio, if any, associated with a still image; and thumbnails of motion images will contain only one (1) frame of a motion image without audio.
The Automatic Image Sorting Function of the Service allows each Member to sort their Images uploaded to the Storage (defined in Section 7). When a Member uploads an Image to the Storage, the Image is automatically analyzed, and that analyzed information is recorded as annotation data to the Image. If a Member has applied an image sorting rule before uploading an Image, the Image will automatically be sorted according to that image sorting rule. However, the Image may not be sorted as the Member intended, depending on, for example, the shooting situation and/or subject conditions. If a Member wants to modify or delete the recorded annotation data of an Image, the Member must do so manually.
The Service allows Members to link their Image to certain Social Networking Services and other services operated by third parties (the “Linked Services”). The Linked Services operate under their own sets of terms. If a Member uses one (1) of these Linked Services, the Member will be bound by the Linked Service’s specific terms of use. Please see Section 11 for full details.
2. Modification of Terms
These Terms may be updated or modified by Canon at any time, for any reason or for no reason, in Canon’s sole discretion. In the event Canon makes materially adverse changes to these Terms, Canon will send e-mail notice(s) to Members and/or post notice(s) on the website and in apps of the Service prior to the changes taking effect. The Members should check these Terms each time the Members use the Service for any changes. Please note that if a Member does not agree to the modified Terms, the Member may not use the Service.
Canon reserves the right, periodically and at any time, to modify or suspend or terminate functions and features of the Service with or without a notice.
3. Suspension and Termination of Service and of Member’s Use of Service
Canon may suspend or terminate the Service at any time, at Canon’s convenience in Canon’s sole discretion. If Canon decides to suspend the Service, Canon will send e-mail notice(s) and/or post notice(s) on the website and in apps of the Service prior to such suspension taking effect (only if the circumstance allows). If Canon decides to terminate the Service, Canon will send e-mail notice(s) and/or post notice(s) on the website and in apps of the Service prior to such termination taking effect.
In the event of a Member’s actual or suspected unauthorized use of the Service or non-compliance with these Terms, Canon may, at its sole discretion and without any notice, suspend or terminate a Member’s use of the Service and this may result in deletion of all of the Content and Members’ personal information the Member stores in the server of the Service by using the Service. Canon will not be responsible for any loss of Member’s Content resulting from such suspension or termination.
4. Electronic Communications
When Members use the Service or send e-mails to Canon, the Members are communicating with Canon electronically. The Members consent to receive communications from Canon electronically, including push-notices to his or her mobile device. If a Member would prefer not to accept push-notices, most mobile devices will allow such Member to change such Member’s device settings to turn off push-notices.
Canon will communicate with the Members by e-mail, by posting notices on the website or in apps of the Service, or by a push-notice on Member’s mobile device. Each Member is responsible for maintaining a valid e-mail address registered in the Member’s Canon ID account and Canon is not responsible for any undeliverable e-mail notifications.The Members agree that all agreements, notices, disclosures and other communications that Canon provides to the Members electronically satisfy any legal requirement that such communications be in writing.
5. Start of Use
In order for a user to start to use the Service, he or she needs to register for a Canon ID account beforehand. The Service is only available to individuals who: (i) are the age of majority, as defined in the jurisdiction in which he or she resides; and (ii) own and register qualified Canon products. Access and use of the Service by anyone under the age of majority is only permitted with the express permission of his or her parent or legal guardian who registered for the Service in the parent or legal guardian’s own name. If anyone under the age of majority uses the Service, his or her parents or legal guardians are deemed to have allowed the use. Such parents or legal guardians are responsible for the access and use of the Service by such minor as if the access and use of the Service by such minor was access or use by the parent or legal guardian.
6. Termination of Use
A Member may terminate use of the Service at any time. The Member may delete, or ask Canon to delete, his or her Content and personal information the Member stores in the server of the Service. If a Member is dormant for the duration set out in the Section 7 below, the Member’s Content will be deleted in a manner set out in Section 7 below.
7. Content Storage
Members may upload and store an Image on storage under the Service (the “Storage”). The Storage has the maximum storage capacity limitation set by hosting service provider(s) employed by Canon for the Service. Storage capacity or period for Storage is available on the website or in apps for the Service. An Image is stored in Storage for a maximum of thirty (30) days from the day the Image is uploaded. AFTER THE THIRTY (30) DAY PERIOD, THE IMAGE WILL BE FIRST INACCESSIBLE TO RELEVANT MEMBERS AND THEREAFTER AUTOMATICALLY DELETED.
Once the Image is deleted, it cannot be recovered. Members can check the dates for any scheduled deletion of an Image on the website and in the apps of the Service.
Canon reserves the right, at any time and from time to time, to change the capacity and/or the period of Storage. In the event Canon makes a change to the capacity and/or the period of Storage that negatively affect Members, Canon will send e-mail notice(s) and/or post notice(s) on the website and in apps of the Service prior to the changes taking effect. Each Member is responsible for maintaining a valid e-mail address registered in the Member’s Canon ID account and Canon is not responsible for any undeliverable e-mail notifications.
IF A MEMBER DOES NOT ACCESS THE SERVICE BY LOGGING ON HIS OR HER CANON ID ACCOUNT FOR ONE (1) YEAR FROM THE DATE OF HIS OR HER LAST LOGIN, ALL THUMBNAILS WILL BE FIRST INACCESSIBLE TO RELEVANT MEMBERS AND THEREAFTER AUTOMATICALLY DELETED. Once a thumbnail is deleted, it cannot be recovered. Canon will not notify Members of the deletion of thumbnails.
8. Sharing with Third Parties
Members may share an Image with third parties by sending a link by e-mail or using a third party's service or other methods. Such link is valid for only two (2) weeks from the time such link is generated. If the Service is used to send an e-mail to a third party, the e-mail address of such third party will be stored in the Service for future use by the Member only, unless the Member deletes it. Prior to using or storing a third party’s e-mail address in the Service, a Member must obtain the third party’s consent. Members are prohibited from using or storing a third party’s e-mail address in the Service if the third party has instructed or requested the Member to not use or store the third party’s e-mail address in the Service or otherwise. Members agree to honor any request received from a third party to delete the third party’s e-mail address. Members further agree that they will not harass third parties by persistently sending them third party links to any Image.
Once an Image has been shared with a third party, the Image may subsequently be shared further by such third party with any other person(s) (who under these Terms shall also be referred to as third party(ies)) without any further notice to the Member. Each Member consents to this sharing of an Image by a third party and each Member agrees that he or she is responsible for the Image at all times. Each Member also agrees that Canon will not be responsible for any loss or damage a Member may suffer as a result of Image sharing.
9. Removal or Disclosure of Content and Other Information
Canon does not have responsibility to control or supervise Members' actions in use of the Service. Nor does Canon have responsibility to monitor the Service. However, Canon is entitled to review and remove and delete any Content if Canon considers that the Content or sending the Image (including any links created to share the Image) falls under any of the prohibited contents/conduct set forth in Section 13 or if to do so may otherwise be in the best interests of Members or Canon. This may include any Content which breaches these Terms.
Subject to the Privacy Policy mentioned in Section 15, Canon may also disclose any information about the Members or any of Members’ Content or remove or delete any Content, if Canon considers it necessary to do so to satisfy any applicable law, regulation, legal process or government request, or to protect others from possible harm.
10. Annotation Data
Members acknowledge that when a Member uploads an Image to the Service, annotation data (information embedded in the Image, such as camera setting, date and time of photographing and comment) may also be uploaded. Annotation data may also include personal information, such as name of photographer and geographical information; and the storage and use of any personal information shall be governed by the Privacy Policy as mentioned in Section 15 below. Members acknowledge and agree that if a Member sends a link to an Image to a third party, annotation data associated with that Image will be embedded in the Image.
11. Third Party Link
The Service allows Members to link their Image to the Linked Services. A listing of Linked Services is available on the website or in apps for the Service. Members agree that Canon is not responsible for the Linked Services, including external websites directed by using the Linked Services, and that Canon does not endorse and is not responsible for any content appearing on or available from the Linked Services, or the connectivity or availability of the Linked Services. Members also agree that Canon is not responsible for any loss or damage caused by a Member’s use of or reliance on the Linked Services.
12. Intellectual Property
A Member retains ownership of his or her Image. By uploading an Image to the Service, a Member grants Canon (including its affiliated companies and third party service providers and business partners) right and license to copy or otherwise use, on a worldwide basis, free of charge, the Member’s Content for the purpose of (a) providing the Service, (b) improving the Service, and (c) improving and developing current and future Canon products and services, including supporting one (1) or more trainable datasets used in AI (artificial intelligence) engines. The right and license continue until relevant Content from the Service is deleted.
Each Member represents and warrants that the Content is either owned by the Member and he or she has all permissions required to distribute the Content, and that Canon and its respective service providers are free to exercise the license rights granted herein without obtaining permission, consent or any license from any third party.
13. Prohibited Conduct
Members agree not to use the Service to:
(i) upload or otherwise make available, or send a third party, any Content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of person's privacy, hateful, or racially, ethnically or otherwise objectionable;
(ii) upload or otherwise make available, or send a third party, any Content that would infringe any patent, trademark, trade secret, copyright, or other proprietary rights of any party, or that would breach any obligation of confidence or any personality right or right to privacy of any third party;
(iii) upload or otherwise make available, or send a third party, any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, or information about pyramid schemes;
(iv) upload or otherwise make available, or send a third party, any Content that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
(v) harm minors in any way;
(vi) “stalk” or otherwise harass any person;
(vii) impersonate any person or entity or falsely state or otherwise misrepresent Member’s affiliation with a person or entity;
(viii) forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service;
(ix) interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;
(x) intentionally or unintentionally violate any applicable local, state, national or international laws or any applicable regulations;
(xi) engage in conduct that restricts, inhibits or discourages any other person or entity from using or enjoying all or any portion, features or functions of the Service, or which, in Canon’s judgment, exposes Canon or any of its users, customers, or suppliers to any liability or detriment of any type;
(xii) engage in conduct affecting Canon adversely or reflecting negatively on Canon, the Service, Canon’s goodwill, name or reputation or causing duress, distress or discomfort to Canon or anyone else, or discouraging any person or entity from doing business with Canon; and/or
(xiii) take any other action that could endanger or cause damage to Canon, other users of the Service, or other third parties.
14. No commercial use of Service
The Service is provided for non-commercial use only. Members may not use the Service for any commercial purpose. Canon will not be liable for any loss or damage a Member may suffer as a result of Member’s use of the Service. Members shall not offer access to the Service to anyone else on a commercial basis.
15. Privacy Policy
Canon shall treat personal information of the Member or a third party, which is uploaded for the purposes of using the Service, in accordance with the applicable laws and regulations and with the Privacy Policy set by Canon and available at https://myid.canon/canonid/#/policy.
16. Usage Survey
As set out in the Cookie Policy for this Service (available at https://image.canon/st/en/cookie-policy.html), this Service uses Google Analytics or Firebase Analytics (provided by Google LLC), web analytics services that use cookies including analytics cookies. Analytics cookies collect and report information about operation status of this Service and usage of this Service by visitors without identifying any individual. In this way, Canon will collect information regarding the usage of the Service. Canon will use such collected information to upgrade the Service and to improve its quality. To learn how Google Analytics collects and processes information, visit the “How Google uses information from sites or apps that use our services” (www.google.com/policies/privacy/partners/) page. In connection with Canon’s use of such analytical services, cookies and other information may be stored or accessed on your device.
17. Member responsibilities / Indemnification
The Service is currently provided at no charge, but a Member accesses and uses the Service at Member’s own expense. Such access may involve third-party fees, such as Internet service provider charges, telecommunication charges or third party charges, and a Member is solely responsible for those fees. Members are responsible for all equipment necessary to access and use the Service.
Each Member agrees to indemnify, defend and hold Canon and all of their respective agents, directors, officers, employees, information providers, licensors and licensees (collectively, the "Indemnified Parties") harmless from and against any and all liability and costs and expenses (including, without limitation, attorneys' fees and costs), incurred by the Indemnified Parties in connection with a Member’s use of the Service or any claim in connection with or resulting from any breach by a Member of these Terms. Each Member agrees to cooperate fully in Canon's defense of any such claim. Each Member agrees that Canon shall be entitled to select its own counsel, at the Member’s expense, to defend it in connection with any claim subject to indemnification by a Member. Each Member agrees that Canon, and not the Member, will have control over the defense of any such claim. Each Member further agrees that the Member will not in any event settle any matter involving Canon, whether or not the settlement binds or is on behalf of Canon, without the written consent of Canon.
18. Disclaimer of Liability
Canon does not have responsibility to control or supervise Members' actions in use of the Service. Nor does Canon have responsibility to monitor the Service. Canon is not responsible as an author, editor or publisher for any Content. Nor is Canon responsible for any offensive, inappropriate, obscene, defamatory or otherwise unlawful or objectionable content or information that may appear on the Service or for any conduct, whether online or offline, of any Member. Canon is not responsible for any acts of any third party.
Canon endeavours to provide uninterrupted and safe service, but no website for the Service can be guaranteed to be available all the time or without any errors. The Service may also have to be taken offline, or have certain functions disabled, to allow for repairs, maintenance, or introduction of new functions or services. Canon makes no commitment that the Service will be permanently available or available at any particular time, that Service has limitation on downtime, that Service will be safe, secure or error-free, that Service will always function without disruptions, delays or imperfections, or that Members’ Content will not be inadvertently removed, deleted, corrupted or lost. Canon has no obligation to maintain, support, upgrade or update the Service. Canon recommends that each Member makes a back-up copy of all of the Member’s Content. Canon is not responsible for any loss or damage of the Member’s Content or any other data that may result from Member’s use of the Service, or for any loss or damage the Member may suffer as a result of the termination of the Service or any failure of, error in or non-availability of the Service.
Canon is not responsible for (i) losses that were not caused by any breach of these Terms on Canon's part, (ii) any business losses (including loss of profit, revenue, contract, expectancy interest, data, goodwill or wasted expenditure), (iii) any losses that were not foreseeable to both the Member and Canon when the Member commenced using the Service, or (iv) any losses caused by Member’s breach of these Terms.
Regardless of any other provisions of these Terms, nothing in these Terms excludes or limits Canon's liability for fraud, fraudulent misrepresentation, or death or personal injury caused by Canon's negligence. Nor does it exclude or limit any other liability that cannot be excluded or limited under applicable law.
A MEMBER’S USE OF THE SERVICE IS SOLELY AT HIS OR HER OWN RISK. THE SERVICE (INCLUDING ALL CONTENT AND FUNCTIONS MADE AVAILABLE ON OR ACCESSED THROUGH THE SERVICE) IS PROVIDED "AS IS." TO THE FULLEST EXTENT PERMISSIBLE BY LAW, CANON MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER (1) FOR THE ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT OF ANY CONTENT PUBLISHED ON OR AVAILABLE THROUGH THE SERVICE, (2) THAT THE SERVER THAT MAKES THE SERVICE AVAILABLE IS FREE OF VIRUSES OR OTHER COMPONENTS THAT MAY INFECT, HARM OR CAUSE DAMAGE TO MEMBER’S COMPUTER EQUIPMENT OR ANY OTHER PROPERTY WHEN MEMBER ACCESSES, BROWSES, DOWNLOADS FROM OR OTHERWISE USES THE SERVICE, (3) THAT CANON WILL CONTINUE TO PROVIDE THE SERVICE OR, IF IT DOES CONTINUE TO PROVIDE THE SERVICE, THAT THE SERVICE WILL CONTINUE TO PROVIDE THE SERVICE IT CURRENTLY PROVIDES OR THAT THE SERVICE WILL FUNCTION THE WAY THAT IT CURRENTLY DOES; OR (4) THAT ANY OF MEMBER’S CONTENT OR COMMUNICATIONS WILL BE RETAINED OR STORED ON THE SERVICE FOR ANY PARTICULAR AMOUNT OF TIME.
UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, CANON'S NEGLIGENCE OR GROSS NEGLIGENCE, WILL CANON, OR ANY OTHER PARTY INVOLVED IN CREATING, HOSTING OR DELIVERING THE SERVICE, BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR OTHER DAMAGES WHATSOEVER ARISING OUT OF A MEMBER’S ACCESS TO, OR USE OF, THE SERVICE, EVEN IF CANON HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. PLEASE NOTE THAT SOME JURISDICTIONS MAY NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR CONDITIONS, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO EVERY MEMBER. CHECK LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THE EXCLUSION OF IMPLIED WARRANTIES.
CANON DISCLAIMS ALL WARRANTIES, EXPRESS AND IMPLIED, TO THE GREATEST EXTENT PERMITTED BY LAW. CANON ALSO ASSUMES NO RESPONSIBILITY, AND WILL NOT BE LIABLE FOR, ANY DAMAGE TO OR VIRUSES THAT MAY INFECT A MEMBER’S COMPUTER EQUIPMENT OR OTHER PROPERTY, OR FOR ANY LOSS OR CORRUPTION OF DATA ON ACCOUNT OF A MEMBER’S ACCESS TO, USE OF, OR BROWSING IN THE SERVICES, OR A MEMBER’S DOWNLOADING OF ANY MATERIALS, DATA, TEXT, IMAGES, VIDEO, OR AUDIO FROM THE SERVICE. NOTWITHSTANDING THE LIMITATION OF LIABILITY CONTAINED HEREIN, IN NO EVENT SHALL CANON'S TOTAL LIABILITY TO A MEMBER FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT OR OTHERWISE) EXCEED THE AMOUNT PAID BY THE MEMBER, IF ANY, FOR ACCESSING THE SERVICE.
19. No Third Party Beneficiaries
As a Member, you agree that, except as otherwise expressly provided in these Terms, there shall be no third party beneficiaries to these Terms.
20. Canon's Trademarks
Canon trademarks, logos, and service marks (collectively, the "Trademarks") displayed on the Service are marks of Canon. All other trademarks, trade names, product names, service marks and all other non-Canon marks are the property of their respective owners. Nothing contained on the Service should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademark displayed on the Service without the written permission of Canon or such third party that may own other trademarks displayed on the Service. The absence of a product or service name or logo anywhere in the text of the Service does not constitute a waiver of any trademark or other intellectual property rights concerning that name or logo. Members may not display or use in any manner the Canon or Canon group trademarks, logos and service marks without Canon's prior written permission.
21. No Waiver
No failure of a Member or Canon to enforce any right under these Terms shall constitute a waiver of such right or provision or affect Member’s or Canon's right to later enforce or exercise it.
22. Severability
If a court finds that any of these Terms is invalid or unenforceable, this shall not affect the validity or enforceability of the rest of these Terms.
23. Definition of Canon and Choice of Law and Forum
In these Terms, “Canon” shall mean one (1) of the following Canon group entities depending on the country/region of your residence and Canon Inc., and if there is a dispute between the Member and Canon related to these Terms or otherwise to the Service, the law and dispute settlement procedure set out below shall apply:
a. If a Member is a resident in Japan, Canon Marketing Japan Inc., located at CANON S TOWER 16-6, Konan 2-chome, Minato-ku, Tokyo 108-8011, Japan (Contact address: https://canon.jp/), and disputes shall be governed by the laws of Japan and submitted to the exclusive jurisdiction of Tokyo District Court;
b. If a Member is a resident in the Europe, Middle East or Africa, Canon Europa N.V., located at Bovenkerkerweg 59, 1185 XB Amstelveen, The Netherlands (Company Registration Number: 33166721; VAT Registration Number: NL005916343B01, Contact address: www.canon-europe.com), and disputes shall be governed by English law and submitted to the non-exclusive jurisdiction of a court located in England;
c. If a Member is a resident in the United States or Latin America, Canon U.S.A., Inc., located at One Canon Park, Melville, NY 11747, U.S.A. (Contact address: www.usa.canon.com), and disputes shall be governed by the laws of the State of New York, U.S.A., and submitted to the non-exclusive jurisdiction of the federal court located in the city of New York, State of New York, U.S.A.;
d. If the Member is a resident in Canada, Canon Canada Inc., located at 8000 Mississauga Road, Brampton, Ontario L6Y 5Z7, Canada (Contact address: www.canon.ca), and disputes shall be governed by the laws of the Province of Ontario, Canada and submitted to the exclusive jurisdiction of a court located in Ontario, Canada;
e. If a Member is a resident in Singapore, Bangladesh, Brunei, Cambodia, Hong Kong, Indonesia, Macau, Nepal, Malaysia, Maldives, Myanmar, Pakistan, the Philippines Sri Lanka, Mongolia, Taiwan, Thailand, or Vietnam, Canon Singapore Pte. Ltd., located at 1 Fusionopolis Place #14-10 Galaxis, Singapore 138522 (Contact address: dpo@canon.com.sg), and disputes shall be governed by the laws of the Singapore and submitted to the non-exclusive jurisdiction of a court located in the Singapore;
f. If a Member is a resident in India, Canon India Pvt. Ltd., located at 7th Floor, Tower B, Building #5, DLF Cyber Terraces, DLF Phase III Gurgaon-122002, Haryana, India (Contact address: www.canon.co.in), and disputes shall be governed by the laws of India and submitted to the non-exclusive jurisdiction of a court located in Delhi;
g. If a Member is a resident in Republic of Korea, Canon Korea Inc., located at 607, Teheran-ro, Gangnam-gu, Seoul, Republic of Korea (Contact address: kr.canon ), and disputes shall be governed by the laws of Republic of Korea and submitted to the non-exclusive jurisdiction of a court located in Republic of Korea; and
h. If a Member is a resident in Australia, New Zealand or other country or region in Oceania, Canon Australia Pty. Ltd., located at Building A, The Park Estate, 5 Talavera Road, Macquarie Park New South Wales 2113, Australia (Contact address: www.canon.com.au), and disputes shall be governed by the laws of the state of New South Wales, Australia or New Zealand (governing law will be selected depending on which country/region the Member resides) and submitted to the non-exclusive jurisdiction of a court located in Australia or New Zealand (forum will be selected depending on which country/region the Member resides).
Availability of the Service in any country or region is subject to such Service not being unlawful or restricted under the laws and regulations of such country or region.
